Sued For Credit Card Debt? Don't Panic!

Being Sued is Stressful
Are you one of the many thousands of American citizens beings sued for credit card debt? It's seems to be a growing trend. Credit card companies give up trying to collect credit card debt, write it off against their business, then sell that same debt to bulk or credit card debt buyers for pennies on the dollar. The bulk or junk debt buyers then turn around and sue the consumer for the full balance left unpaid on the credit card debt. These people are despicable. They're vultures.

The gall of the huge financial and credit card companies who got huge bail outs of the tax payer's dollars in 2008 to now sell out on Americans who are already down and out. It's incredible but true that much of those tax payer's dollars also went to bail out foreign banks. Think about the gall of bulk debt buyers for buying debt for mere pennies on the dollar, only to turn around and sue people for the full amount of an unpaid credit card account that was closed several years ago and does not even show up credit reports.

Don't Panic

Sued for Credit Card Debt?
Don't Go Out & Get Drunk
It is a very upsetting thing to be served with a summons that you are being sued and you're required to be in court to defend yourself before a judge on a specific date. Stay calm. Don't panic. Don't get depressed. Don't get drunk. Don't immediately start thinking of bankruptcy either. Take some time to calm down and think things through. .

You will get over this and there might be a good chance to win the lawsuit against you. This is especially true if you're being sued by a bulk debt buyer who is not the original owner of the debt.

Bulk Debt Buyers Seldom Have Adequate Evidence to Win Their Court Case

Don't Let Credit Card Suit
Put You in Depression
If the plaintiff suing you is a debt buyer, the good news is that they seldom have adequate evidence to win their case in court. Very often, they do not have the documents that show your signature or terms of a credit card agreement. The burden of proof is on them to prove that the defendant owes them the debt. If they don't have the proper evidence, then the judge should rule against them.

Junk debt buyers know they don't have adequate evidence to prove their case, but they sue anyway because most people let fear paralyze them and they don't even answer the summons. They choose not to challenge it nor to fight the debt buyer's suit. So, if they don't show up, the judge has no choice but to believe the debt buyer. The debt buyer wins by default. They then can have the court issue them the authority to wipe out the defendant's bank account and garnish their wages for money they never borrowed from them. Chances are that they've never had any contractual agreement with the plaintiff and the debt they claim the defendant owes them may not even be theirs. .
